Terms & Conditions
These website terms explain how visitors may use the Conn Web Studio website and provide general information about our services. If you become a client, your accepted proposal and signed service agreement set out the specific scope, fees, payment milestones, delivery arrangements and support terms.
Conn Web Studio is based in Echuca, Victoria. ABN 82 975 957 314. Please read these terms together with our Privacy Policy.
1. Our services
We provide custom website design and related digital setup services for businesses across Australia.
- Website Only: a custom website using content and brand assets supplied by the client, with agreed basic connections and handover.
- Website + Digital Foundations: a custom website plus agreed setup of relevant systems such as bookings, payments, domain, business email and Google Business Profile, with three months of post-launch support as specified in the proposal.
- Website management: optional technical advice, troubleshooting, fixes and agreed changes to systems we have set up, subject to a separate website management agreement.
We do not provide reception, routine administration, inbox or diary management, bookkeeping, social media management or advertising services.
2. Quotes, scope and acceptance
Website prices shown on this site are indicative starting prices unless clearly described otherwise. Your proposal confirms the final price, inclusions, exclusions, timeline and deliverables. Work begins when the agreed acceptance and payment requirements have been met.
Requests outside the agreed scope, including additional pages, functionality or revisions, may require a separate quote and approval before work proceeds.
3. Deposits and payments
Our standard website projects require a 50% deposit to reserve a build slot. The remaining 50% balance is due before launch, or 6 weeks after the project start date, whichever comes first. The start date is the day we have your signed agreement, completed workbook and deposit. Your proposal and service agreement confirm the exact amounts and dates.
Invoices are issued through Xero and are due within 7 days. They may be paid by bank transfer, online card payment or PayPal where available. Third party costs and any payment related fees will be stated in the relevant agreement or invoice.
If an invoice is still unpaid 14 days after its due date, a one off late fee of $35 may be added to that invoice. We will send a reminder first, followed by an updated invoice showing the late fee. The fee is charged once per invoice and does not compound, it is not charged on an amount you are disputing in good faith, and it may be reduced or waived if you contact us to arrange payment before it is added. If you dispute an invoice, please tell us in writing within 7 days so we can resolve it promptly.
We may pause work, or delay launch, while an amount is overdue, after reasonable notice and subject to applicable law and our contractual obligations. If you need more time or a payment arrangement, please get in touch early.
4. Client responsibilities
Clients are responsible for providing accurate information, required content, permissions, timely feedback and access to relevant accounts. Clients must have the rights to use all supplied text, photographs, logos and other materials.
Delays in providing materials or approvals may affect delivery dates. Any revised schedule will be communicated where practicable.
5. Design process and revisions
Our usual process includes a discovery call, proposal and workbook, deposit, first draft, revision rounds, launch, walkthrough and handover. Website Only includes two rounds of revisions and Website + Digital Foundations includes three. Exact deliverables and revision allowances are confirmed in your proposal.
Changes requested after approval or beyond the included revision allowance may be quoted separately. We will seek approval before charging for additional work.
6. Third party platforms and costs
Websites and connected systems may rely on third party providers, including Squarespace, domain registrars, email, booking and payment services. Subscription charges, provider terms, outages, feature changes and transaction fees are controlled by those providers unless otherwise agreed.
Clients remain responsible for maintaining subscriptions and account access after handover unless a separate agreement says otherwise. Any Squarespace Circle discount is subject to the provider's eligibility and offer conditions.
7. Launch, handover and support
We will provide the agreed handover materials and support described in your proposal. Website + Digital Foundations includes three months of support, with its scope and start date confirmed in the service agreement.
Optional ongoing website management is offered under a separate agreement. For new clients it is $249 per month on a 12 month term. Additional hourly help is $150 per hour, with a 1 hour minimum.
The price, commencement, renewal and cancellation arrangements are stated and agreed before the plan begins. There is no automatic commitment to an ongoing plan simply because included support has ended.
Support is limited to agreed services and does not guarantee uninterrupted operation of third party systems.
8. Changes, cancellation and refunds
If either party needs to postpone or cancel a project, the consequences will be assessed under the accepted agreement, the work performed, committed costs and applicable law. A deposit is not automatically nonrefundable in every circumstance.
If a project ends early, we may keep or charge reasonable amounts for work completed, services provided and costs reasonably incurred up to that date, and any amount you have paid above that is refunded. If we cancel the project, you will receive any refund required by law. Any amount retained or charged must be consistent with the agreement and applicable law, including laws relating to unfair contract terms, and we will explain any adjustment or refund.
9. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law, contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Where applicable, services must be supplied with due care and skill, be reasonably fit for a disclosed purpose and be supplied within a reasonable time if no time is fixed. Remedies depend on the circumstances and applicable law.
Standard form contract terms must also comply with applicable unfair contract terms laws.
10. Intellectual property
Clients retain ownership of their pre-existing business materials and content they provide. Ownership and licence rights in completed website deliverables, custom code, design assets, templates and reusable methods are determined by the accepted service agreement and any applicable third party licences.
Unless otherwise agreed, no rights in third party software, fonts, images or platform technology are transferred beyond the licences granted by their owners. Do not reproduce content from this website without permission except as permitted by law.
11. Website information and external links
We aim to keep information on this website accurate and current, but service descriptions, availability and indicative prices may change. The agreed proposal takes precedence for an individual project.
External websites and services are managed by their respective operators. We are not responsible for their independent content, terms or privacy practices, except to the extent required by law.
12. Liability and circumstances outside our control
To the extent permitted by law, we are not responsible for losses caused solely by events outside our reasonable control, such as third party platform outages, client-supplied errors or unauthorised changes after handover. This does not remove liability for our own failure to exercise due care and skill or any non-excludable legal rights.
Any specific liability limits or insurance arrangements must be stated in the accepted service agreement and must comply with applicable law.
13. Privacy, communications and governing law
We handle personal information as described in our Privacy Policy. Marketing communications are subject to applicable requirements of the Spam Act 2003 (Cth).
Electronic communications and agreements may be used where legally valid, including under relevant electronic transactions legislation. These terms are governed by the laws of Victoria, Australia, subject to mandatory laws that apply elsewhere.
14. Questions and changes
We may update these website terms and will show the revision date above. Changes to an existing signed client agreement require the process specified in that agreement and cannot simply be imposed by updating this page.
